PROHIBITED ITEMS POLICY

Celebrain is a marketplace specialized in event organization. However, for various reasons, we must prohibit or restrict certain types of services or products. Some items present legal risks for our community, while others conflict with our values, are harmful to our members, or simply do not align with our philosophy. In this policy, we explain what is prohibited or restricted on Celebrain.

We have a zero-tolerance policy for prohibited items, especially those that promote, support, or glorify any form of hate; those that promote, support, or glorify any form of violence; or those that are illegal. Sellers that we determine have violated this policy may be subject to immediate suspension or account termination in accordance with our Terms of Use.

This policy is part of our Terms of Use. By opening a shop on Celebrain, you agree to this policy and to our Terms of Use. If we have reason to believe that you, Your Content, or your use of the Services violate our Terms, we may disable Your Content for some or all users, or suspend or terminate your account (and any account that Celebrain determines is associated with your account) and your access to the Services. In general, we will send you a notification if we decide to suspend or terminate Your Content or your account, unless you have repeatedly violated our Terms or we have legal or regulatory reasons preventing us from doing so.

Types of Prohibited or Restricted Items on Celebrain

The following types of items are prohibited or restricted on Celebrain:

  • Tobacco, drugs, drug paraphernalia, pharmaceuticals and medical devices, and items with medical claims.

  • Animal products and human body parts and fluids.

  • Hazardous items: dangerous substances and devices, salvaged items, and weapons.

  • Hate items: items that promote, support, or glorify any form of hate.

  • Illegal items, items that promote criminal activity, and highly regulated items.

  • Items subject to international regulation.

  • Nudity and sexual content.

  • Violence-related items: items that promote, support, or glorify any form of violence.

Decisions regarding site policies are complex. We must consider many different—and often conflicting—factors before determining what is best for our community. As a creative community, we sometimes aim to foster freedom of expression. We also tend to allow items with educational, historical, or artistic value, though we understand that even such items may be subject to various valid—sometimes contradictory—interpretations and emotional responses. Art and history can be provocative, emotional, and divisive. There are topics on which we may never reach community-wide consensus, but that is not a problem.

We reserve the right to remove listings that we determine do not align with the philosophy of Celebrain. Violating this policy may result in suspension or loss of member privileges.

 

1. Tobacco, Drugs, Drug Paraphernalia, Pharmaceuticals and Medical Devices, and Items with Medical Claims

Tobacco and drugs are prohibited on Celebrain. These items may be subject to legal requirements and, in some cases, classified as controlled substances under applicable laws in Costa Rica. Our policy also applies to pharmaceuticals, medical devices, and any other item claiming to treat, prevent, mitigate, cure, or diagnose a disease or medical condition. Regardless of potential legal restrictions, these items do not align with Celebrain’s philosophy.

Examples of items that may NOT be sold on Celebrain:

  • Tobacco products, smokable items, electronic cigarettes, and e-cigarette liquids.

  • Drugs and certain toxic herbal substances, including those used for recreational or medicinal purposes, regardless of legality.

  • Depictions or descriptions of these substances in listing photos, as well as listings for instructions or materials to create such items.

  • Drug paraphernalia, including: carburetor items, tubes, bongs, bubbler pipes, vaporizers and their components.

  • Regulated pharmaceuticals and medical devices.

  • Items making certain medical claims.

 

2. Animal Products and Human Body Parts and Fluids

Some animal and human products are highly regulated and prohibited on Celebrain due to the risk of harming live, companion, or at-risk animals.

Examples of prohibited animal and human products:

  • Live animals.

  • Items created using any animal species classified as threatened or endangered, or certain at-risk animals under applicable laws and international conventions such as CITES (Convention on International Trade in Endangered Species of Wild Fauna and Flora).

  • Items made with dog or cat parts or skins, pursuant to applicable law.

  • Ivory or bones from ivory-producing animals, such as tusks, elk ivory, fossilized ivory, and woolly mammoth ivory.

  • Human remains or human products, or human body parts.

Exceptions: Examples of PERMITTED items:

  • Leather goods (e.g., leather handbag).

  • Textile products made with animal hair (e.g., authentic mohair scarf).

Additional Information:
We expect each of our members to comply with the local laws applicable to them in Costa Rica.

 

3. Hazardous Items: Dangerous Substances and Devices, Salvaged Items, and Weapons

For legal and safety reasons, we prohibit certain hazardous items in our marketplace.

 

Dangerous Substances and Devices

Due to the potential harm posed by dangerous substances and devices, as well as the complex shipping and legal regulations associated with them, dangerous substances and devices are prohibited on Celebrain. We also prohibit kits, instructions, patterns, and designs that enable the creation of such items.

Examples of prohibited dangerous substances and devices (non-exhaustive list):

  • Explosives (fireworks, firecrackers, or flares) and previously explosive items.

  • Flammable items, gases, radioactive material, toxic substances (e.g., poisons).

  • Loose or individual lithium-ion batteries.

  • Certain ingredients considered hazardous in specific contexts.

 

Salvaged Items or Items That May Pose Health or Safety Risks

It is prohibited to sell on Celebrain any items that:

  • Pose a health or safety risk, including items that present choking, electrocution, or strangulation hazards.

  • Include certain loose or separable magnets that fit into a “small parts” cylinder and have significant magnetic flux, due to ingestion hazards.

 

Weapons

When defining what may or may not be considered a weapon, context is very important. When in doubt, it is safest to assume that we will not allow any item intended to be used as a weapon to cause harm.

The following items are NOT allowed on Celebrain:

  • Firearms, knives, and other bladed weapons (even if vintage).

  • Replica weapons that appear real or are prohibited under applicable laws in Costa Rica.

  • Patterns, designs, blueprints, or instructions to create prohibited weapons.

Examples of PERMITTED items:

  • Kitchen knives or other knives used as tools.

  • Letter openers.

  • Airsoft guns and other harmless toy guns (with some restrictions).

 

4. Hate Items: Items That Promote, Support, or Glorify Any Form of Hate

We want Celebrain to be a community that welcomes people of all backgrounds, nationalities, and religions, as well as all artistic tastes and senses of humor.

Celebrain does not allow items or listings with violent or derogatory language toward others based on race, ethnicity, nationality, religion, sex, gender identity, disability, sexual orientation, immigration status, or caste (collectively, "protected classes"). We also prohibit items and content that promote organizations aligned with such ideas.

The following items are NOT permitted on Celebrain:

  • Content containing direct or indirect violent or derogatory comments against protected classes.

  • Items that support or glorify current or historical hate groups, including their leaders, propaganda, or collectibles.

  • Hate groups include, for example, Nazi or neo-Nazi groups, Ku Klux Klan (KKK), white supremacist groups, misogynistic groups, or groups promoting homophobic, anti-immigration, or Holocaust-denial ideologies.

  • Items containing slurs or derogatory terms referring to protected classes.

Examples of PERMITTED items:

Some items may contain symbols or terms associated with hate rhetoric in a context not intended to promote hate.

We understand such items may be subject to different valid interpretations of their educational, historical, or artistic value, often conflicting. While we acknowledge that consensus may not exist, we reserve the right to evaluate these items individually and case by case.

 

5. Illegal Items, Items That Promote Criminal Activity, and Highly Regulated Items

Celebrain complies with the law, and we expect our sellers to do the same.

Illegal items, items that promote illegal activities, and stolen items are not allowed on Celebrain. Nor are items subject to complex legislation or registration systems. We require sellers to comply with all applicable laws regarding the services or products they list in Costa Rica. Listings may become unavailable to users living in regions where purchase or sale of the item or service is restricted.

Celebrain works with law enforcement to take action on stolen items. You may report stolen products to Celebrain by writing to proveedores@gocelebrain.com. If you suspect an item on Celebrain may be stolen, we also recommend reporting it to local law enforcement.

All forms of illegal activity are strictly prohibited. This includes, but is not limited to, the sale of:

  • Unauthorized goods or counterfeits.

  • Personal information.

  • Highly regulated items such as currency and real estate.

  • Listings that encourage or promote illegal activities such as identity theft, evasion of illegal activity detection, or fake credentials.

Unauthorized replicas or copies:
Unauthorized replicas or copies of items, as well as patterns or designs that enable their creation, are prohibited on Celebrain.

Counterfeit or unauthorized products imitate an authentic product, especially using the brand’s name or logo, or a protected design without permission.

Items upcycled or repurposed using a brand’s name, logo, or protected design without permission may also be considered counterfeit—even if the materials are authentic.

Examples include:
Replicas of luxury and non-luxury brand-name items such as handbags and clothing.

Privacy and personal documents:
Content that violates the privacy, publicity, or personal rights of others is prohibited.

Personal information cannot be sold (e.g., mailing lists, banking data).
Government or personal documents (credit cards, IDs, licenses) are also prohibited.

Financial and high-risk items:
Due to regulations, the following cannot be sold on Celebrain:

  • Lottery tickets

  • Cryptocurrency mining equipment

  • Postage or currently convertible currency

  • Financial instruments such as stocks, bonds, and securities

  • Items made by a seller incorporating any of these items in usable form

Collectible coins or stamps valued under $1000 USD are allowed unless subject to legal restrictions.
Collectible coins may not be listed as “unsearched” or as mixed lots of indeterminate contents.

Real estate and vehicles:
Due to complex legal restrictions varying by location, Celebrain does not allow the sale of real estate or motor vehicles (e.g., cars, motorcycles, boats, trailers).

Impersonation and evasion of the law:

Items may not contribute to impersonating an identity.
We prohibit realistic items identifying the wearer as an active police, military, or government officer.

We prohibit items intended to evade detection of illegal activity, such as:

  • Radar detectors

  • License plate covers

  • Materials to avoid positive drug test results

We also prohibit:

  • Items enabling the creation of fraudulent credentials (rideshare stickers, fake diplomas or licenses, bank statements, pay stub templates).

  • Items intended to deceive others about someone's medical condition (fraudulent test results, fake support animal designations).

  • Items that fraudulently violate another person’s privacy (hidden cameras, trackers, lock picks).

 

6. Nudity and Sexual Content

We strive to balance community safety with creative expression. We prohibit pornography, sexual services, illegal items or items that promote exploitation, and certain types of adult toys.

In some cases, adult nudity is allowed, although some images may need to be blurred to warn users who prefer not to see such content. If your items contain adult content, including photographic representations of breasts or buttocks, we ask that you be respectful of different sensitivities and properly list and tag your items.

We prohibit items that do not align with Celebrain’s brand and values, or that may involve legal or other restrictions.

Depictions of sexualization of minors are strictly prohibited.

Examples of PERMITTED items:

  • Illustrations (i.e., non-photographic or non-photorealistic content) that include female nipples (example: nude paintings).

  • Illustrations that include buttocks (example: watercolor nude painting).

  • Illustrations of genitals without sexual content (example: penis-shaped lollipops).

 

7. Violence Items: Items That Promote, Support, or Glorify Any Form of Violence

We want Celebrain to be a safe place for everyone. While violent content may be a legitimate part of history, education, or artistic expression, it must never be used to promote or glorify violent acts against others.

We do not allow items or listings that promote, support, or glorify violent acts or harm toward oneself, others, or animals, including credible threats of harm.

The following items are NOT allowed on Celebrain:

  • Items that glorify human suffering or tragedies, including items that praise or honor perpetrators of violent acts.

  • Items that glorify or celebrate real incidents of violence or natural disasters.

  • Items that threaten or incite violent acts against individuals or groups.

  • Items that promote or support terrorism or terrorist organizations.

  • Items that promote self-harm, starvation, or other types of self-injury.

  • Items that promote or endorse harmful misinformation.

Graphic material such as items with violent, gory, or profane text or images must follow our adult content policy.

Examples of PERMITTED items:

  • Commemoration of violent events without glorification (example: World War I–themed items).

  • Items with vague or nonspecific violent rhetoric that do not indicate a credible threat of real-world harm (example: T-shirts with non-literal violent slogans).

  • Items that minimize violent incidents or perpetrators without glorification or praise.
