INTELLECTUAL PROPERTY POLICY

At Celebrain, as a meeting point for professionals and creators in the events industry, we take intellectual property rights very seriously. We comply with intellectual property laws and industry best practices to maintain the integrity of our specialized event-organization marketplace. This Intellectual Property Policy explains how we address claims of infringement, how authorized parties may submit infringement reports related to content on our marketplace, and how Celebrain sellers may respond when their listings or shops are affected by a report. This policy is part of our Terms of Use.

 

1. The Role of Celebrain

Celebrain is a marketplace composed of independent third-party sellers who manage their own shops, write their own policies, and are responsible for their services, products, and compliance with applicable laws. Celebrain provides the platform to connect event organizers with professionals, but we do not manufacture products, store inventory, or manage shipments or services on behalf of sellers.

The content uploaded to the Celebrain marketplace is generated by independent sellers who are not employees, agents, or representatives of Celebrain. Sellers are responsible for ensuring that they hold all necessary rights to their content and that they are not infringing or violating any third-party rights by posting it.

Celebrain reserves the right to disable any listing, shop, or account that, in our judgment, violates the Terms of Use, including the Intellectual Property Policy or the Prohibited Items Policy. Celebrain also reserves the right to take action against those who abuse this Intellectual Property Policy or Celebrain’s Terms of Use.

Celebrain cannot speak on behalf of intellectual property owners, nor can we provide legal advice or make legal determinations regarding whether shop content infringes someone else’s intellectual property. Celebrain will remove material cited for alleged intellectual property infringement when we receive a report that complies with Celebrain’s policies.

2. Intellectual Property Infringement Notices

Celebrain strives to respond promptly when we receive an intellectual property infringement report that meets our policy requirements, by removing or disabling access to the allegedly infringing material.

When Celebrain removes or disables access in response to a report, we will make reasonable efforts to contact the affected member, provide information about the report and the removal, and, in cases of alleged copyright infringement, provide information on how to submit a counter-notification. Celebrain may also provide the affected member with a copy of the infringement report, including the claimant’s name and email address.

To submit a report of alleged infringement against listings, usernames, shop names, or videos on Celebrain, users must send their report to proveedores@gocelebrain.com. Celebrain may request additional information before processing a report, such as an authorization letter from the rights owner, proof to verify the claimant’s identity, or documentation supporting the claimed right.

Celebrain may reject infringement reports or counter-notifications that contain information deemed false, fraudulent, incomplete, or submitted in bad faith. Celebrain also reserves the right to take action against those who abuse this policy.

 

3. Counter-Notification

When Celebrain receives a valid counter-notification, we will provide a copy to the original claimant. The removed material may be replaced or access to it restored, unless the copyright owner initiates legal action to prevent the allegedly infringing party from reposting the items for sale or files a formal complaint with the appropriate authorities and notifies Celebrain of such action.

 

4. Repeat Infringements

Celebrain will revoke selling privileges for members who are subject to repeated or multiple intellectual property infringement notices where appropriate and at Celebrain’s discretion. If we believe that a member has attempted to open a new shop after having their original account closed, we reserve the right to refuse the provision of our services to that member. These actions apply to any accounts that we believe are controlled by or associated with the affected member.

As stated in our Terms of Use, Celebrain reserves the right to terminate account privileges at any time, for any reason, and without prior notice.

 

5. Retractions

Celebrain only accepts retractions of infringement reports if they are issued directly by the intellectual property owner or the authorized representative who submitted the original notice. The retraction must be clearly identified as a formal retraction and must sufficiently identify the member or material involved (including, among others, username, shop name, or the URLs of the relevant Celebrain listings).

Once Celebrain receives a formal retraction, we will contact the retracting party to acknowledge receipt and will notify the affected user of the retraction. Please note that infringement matters are reviewed on a case-by-case basis, and retractions do not guarantee changes to a user's shop status.
